Refresher Training Course: RBE No.348/1985 – Train Passing Staff

Sub: Recommendation No.49 of RAEC-78 part II of their report – Refresher training course for staff connected with train passing duties.

The Railway Accident Enquiry Committee, 1978, in their recommendation No.49 Part-II of their report have observed that staff who fail in refresher training course should not be employed on train passing duties. This recommendation has been noted by the Department of Railways.

Instructions already exist vide Railway Board’s letter No.E(Trg)61/TRI/45, dated 22.08.1966 which provide that staff connected with train passing/ operation of trains who are found unfit during the currency of the certificate of competency or fail in refresher course, should be proceeded against under D&A Rules with a view to terminating their lien and applying them in other posts (in equivalent or lower grades) not connected with train passing duties. A copy of these instructions is attached for ready reference.

Sub: Procedure to be adopted in regard to staff who fail in the knowledge of their train passing operation duties.

1.     In their letter No.E52RRI/15/3, dated 15th April, 1954, the Board had laid down the manner in which staff of Transportation (Traffic) Deptt. who are found unfit in the knowledge of their duties of train passing are to be dealt with. In the light of recent experience, the Board have decided in supersession of previous instructions that the procedure to be followed in future in regard to staff who are carrying out duties of train passing or operation of trains should be as follows. 

2.     Staff found unfit during the currency of the certificate of competency (Vide General Rules 32 and 350) otherwise than at a refresher course:

Such a staff should be granted short leave as may be due and examined again by the authority concerned. If they fail, they may be sent to Railway Training School for a refresher course and examined at the end of the refresher course. If they fail again, they should be granted leave as may be due to cover the intervening period or temporarily utilized in another posts in terms of Board’s letter No.E55AE8-304 (D&A), dated 07.08.1958 and proceeded against under the D&A Rules with a view to terminating their lien and employing them in other posts (in equivalent or lower grades) which do not involve train passing duties. In the case of staff who do not hold the posts in substitute capacity, there is no need to apply the disciplinary procedure for reverting them from those posts.

3. Staff found unfit in the test held in safe working of trains at the end of a refresher course at a Training School vide para 2(a) of Board’s letter No.E/61/TTC/7, dated 28.03.1962:

Special arrangements should be made by the Railway Administrations to repeat the refresher course immediately or after a short period, the staff being granted leave as may be due to cover the intervening period or temporarily utilized in another post as permissible in terms of Board’s letter No.E55AE8-304 (D&A), dated 07.08.1958. If the staff fail in the second chance, disciplinary action may be taken as laid down in para 2 above.

4. In this connection, attention is drawn to rule 152-A R-I introduced vide Board’s letter of even number dated 22.08.1966 which is reproduced below:

“152-A: Periodical Refresher Course for staff connected with train passing and train operation:

Station Masters, Assistant Station Master, Switchmen, Cabinmen, Guards and Drivers, who are employed in train passing duties/ train operation, shall be required to pass the appropriate examination in these subjects at the end of the periodical refresher course. Failure to pass in said examination shall be deemed to be a good and sufficient reason for taking action under the disciplinary rules for the time being applicable to such staff.”

This disposes of correspondence resting with the W. Railway’s letter Nos.E.1136/12, dated 08.11.1965 and No.844.E/229 (Rectt), dated 24.03.1966).

    Pl told in refresh period what is rule of nh and proper rest.where is its come in same time

    One JE/SSE P.way is attending Refresher Course. One derailment occured in his section during his training period. Whether the JE/SSE/P.way will be relieved to attend the derailment enquiry or not?
