RBE No. 26/2007: Promotion – Supervisor (P.Way) – IREM Amendment – ACS No.192 to Para 144

No.E(NG)I-99/PM5/7, dated 23.02.2007

Sub: Filling up of vacancies in the category of Supervisor (P.Way) in the pay scale of Rs.4500-7000 and Junior Engineer (P.Way) Gr-II in the pay scale of Rs.5000-8000 – Recommendations of Railway Safety Review Committee (RSRC) – Implementation thereof.

1. Reference this Ministry’s letter of even number dated 01.01.2003 (RBE No. 02/2003) enclosing herewith ACS No.143 on the above subject.

2. It has come to the notice of this Ministry that non-insertion of a Note below para 144(1)(ii) in the ACS, ibid, pursuant to Para 4 of the covering letter dated 01.01.2003, is by an omission. The same is being rectified. Accordingly, the Indian Railway Establishment Manual, Volume-I, 1989 Edition should be amended as per ACS No.192 enclosed.

Insert the following Note below sub-para 1(ii) of para 144 as amended by ACS No.143 issued under Board’s letter No.E(NG)I-99/PM5/7, dated 01.01.2003 (RBE No. 02/2003):-

Note:- Departmental staff already in service as on 01.01.2003 not possessing the qualification of class X Board Examination but otherwise eligible for promotion against para 144(1)(ii) above may be allowed two chances to appear in the two consecutive selections conducted after 01.01.2003 for promotion as Junior Engineer (P.Way) Gr.II.”

    I was not promoted to higher grade since my seniority was wrongly assigned by Rlys.Thus my juniors were promoted to higher grade posts prior to me.Lastly my next below junior got promoted to SAG grade .Ifiled case at CAT Alld.in the year 1994.The verdict announced directed Rly to promote me in all grades above my next juniorson Oct 1921, by the time I had retired.The court in their verdict put no bar like non payment of back wages on the ground that I had not worked against higher grade postdirected bu ony directed not to give me any financial benifit in lieu of notional promotion
    Now question is if I am entitled for back wages.I lost timely promotion due to adm.error & at no staze & time I had refused to work on higher grade postsNow I feel that according to verdict I am entitled to get payment if back wages
    The case is in court for non compliance of courts verdict which is under courts consideration.
    My query is wheather I am entitled to get back wages paid?
    Kindly give your considered view.
