RBE No. 259/1987: Railway servants (Discipline and Appeal) Rules

Sub: Railway servants (Discipline and Appeal) Amendment Rules, 1987.

GSR …….. In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Railway Servants (Discipline and Appeal) Rules, 1968:

1.     (1)   These rules may be called the Railway Servants (Discipline and Appeal) Amendment Rules, 1987.

(2)   They shall come into force on the date of their publication in the Official Gazette.

2.     In rule 14 of the Railway Servants (Discipline and Appeal) Rules, 1968, for the proviso, the following provisos shall be substituted, namely:

“Provided that the Railway servant may be given an opportunity of making representation on the penalty proposed to be imposed before any order is made in a case falling under clause (i);

Provided further that the Commission shall be consulted where such consultation is necessary, before any orders are made in any case under this rule.”
