Railway Services (Pension) Rules: RBE No.15/2005 – Amendment

Sub: The Railway Services (Pension) (Amendment) Rules, 2005.

S.O. – In exercise of the powers conferred with the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Railway Services (Pension) Rules, 1993, namely:-

1.     (1)   These rules may be called the Railway Services (Pension) (Amendment) Rules, 2005.

(2)   They shall be deemed to have come into force from the 19th day of July, 1997.

2.     In the Railway Services (Pension) Rules, 1993, –

(a)   In rule 53, for sub-rule (1), the following sub-rule shall be substituted, namely:-

“(1) Railway servant who has been permitted to be absorbed in a service or post in or under a Corporation or Company wholly or substantially owned or controlled by the Central Government or a State Government or in or under a body controlled or financed by the Central Government or a State Government shall be deemed to have retired from service from the date of such absorption and subject to sub-rule (3), he shall be eligible to receive retirement benefits, if any, from such date as may be determined, in accordance with the orders of the Railway applicable to him.”

(b)   Rule 54 shall be omitted;

(c)    In rule 75, in sub-rule (21), clause (iii) shall be omitted.
