Liberalised Pensionary Awards: RBE No.246/1987 – IVth CPC

Sub: Liberalized Pensionary awards in the case of death/ disability as a result of (i) attack by or during action against extremists, antisocial elements, etc. and (ii) action against enemy in International war or Border Skirmishes – modifications on the recommendations of the IV Central Pay Commission.

1. Reference this Ministry’s letter No.F(E)III/84/PN 1/20, dated 16.03.1985 introducing liberalised pensionary awards in the case of death/ disability while performing duty as a result of attack by or during action against extremists, anti-social elements, etc. In pursuance of Government decisions on the recommendations of the  IV Central Pay Commission announced in the Department of Pension’s Resolution No.2/13/87-PIC, dated 18th March, 1987 circulated in this Ministry’s letter No.PC-IV/86/Resolution/1, dated 03.04.1987, the President is pleased to make the following modifications in the provisions of the above mentioned letter governing the liberalised pensionary awards.

2. Para 2 of the letter dated 16.03.1985 may be substituted by the following:

“The term ‘Pay’ in these orders means the basic pay in the revised scales promulgated under the Railway Services (Revised Pay) Rules, 1986.

In the case of Railway servants who opt to continue to draw pay in the pre-revised scales beyond 31.12.1985, the term ‘Pay’ will include basic pay in the pre-revised scales of pay plus dearness allowance, additional dearness allowance, ad hoc dearness allowance upto average CPI 608 and the two installments of interim relief appropriate to the basic pay”.

3. In annexure-A to letter dated 16.03.1985 the following modifications may be made:

Family Pension:

3.1 The existing distinction with reference to basic pay at the time of the death of the Railway Servant for grant of family pension will be dispensed with. In all cases of death of Railway Servants while performing duties as a result of attack by or during action against extremists, dacoits, smugglers and anti-social elements, etc., the widow will be entitled to family pension equal to last pay drawn by the deceased Railway servant. The said family pension shall be admissible to the widow until her re-marriage/ death. During this period children’s allowance and children’s education allowance will not be admissible.

3.2 In the event of re-marriage of the widow, ordinary family pension under Manual of Railway Pension Rules, 1950 will be admissible to her from the date following the date of her re-marriage. From the said date children will be allowed children’s allowance as specified in paragraph 3.5.

3.3 If the Railway servant is not survived by widow but is survived by child/ children only, all children together shall be eligible for family pension at the following rates and also draw in addition the Children’s Allowance specified in para 3.5. 

 Basic pay of Railway servant on the date of deathMonthly family pension
(i)Not exceeding Rs.150050% of basic pay
(ii)Exceeding Rs.1500 but not exceeding Rs.300040% of basic pay subject to a minimum of Rs.750.
(iii)Exceeding Rs.300030% of basic pay subject to a minimum of Rs.1200 and maximum of Rs.2500.

The above family pension shall be payable to the children for the period during which they would have been eligible for family pension under the Manual of Railway Pension Rules, 1950. The family pension shall be paid to the senior most eligible child at a time on the lines on which family pension is granted under the Manual of Railway Pension Rules, 1950.

Dependent Pension:

3.4  Where the Railway servant dies as a bachelor or as a widower without children, pension will be admissible to parents without reference to their pecuniary circumstances at 3/4 of pay last drawn by the Railway servant for both parents and at 3/4th of this rate for a single parent. On the death of one parent dependent pension at the latter rate will be admissible to the surviving parent.

Children’s Allowance & Children’s Education Allowance:    

3.5 The Children’s allowance and Children’s Education allowance will be merged together. A consolidated allowance shall be allowed in cases covered by paragraphs 3.2 and 3.3 ante at the following rates per child.

(i)Where pay of the deceased Railway servant on the date of death is less than Rs.2200Rs.100 p.m. per child
(ii)Where pay of the deceased Railway servant on the date of death is Rs.2200 and above.Rs.150 p.m. per child

The consolidated children’s allowance shall be admissible to each child during the period of his eligibility for family pension under the Manual of Railway Pension Rules, 1950.

4. Other provisions of this Ministry’s letter dated 16.03.1985 cited above which are not specifically modified by this order shall continue to remain in operation.

5. The revised provisions of these orders take effect from 01.01.1986 i.e. where casualties take place on or after 01.01.1986.

6. These orders will also cover cases arising out of International wars or war-like operations or border skirmishes with any country or during laying or clearance of mines including enemy mines as also mine-sweeping operations between one month before commencement and three months after the conclusion of the operations, where such casualties take place on or after coming into effect of these orders. The orders issued  in this Ministry’s letter No.F(E)III/72/PN 1/9, dated 10.09.1973 will cease to have effect from 01.01.1986.
