Department Enquiry: Action Against Railway Servants for Prevarication

Sub: Action against Railway servants alleged to have made one statement before a Magistrate and another statement in a department enquiry.
A point has been raised whether, as a general principle, disciplinary action should be taken against staff who, during the course of police investigations make a statement on oath before a Magistrate and subsequently give a divergent statement during the department enquiry.
It is clarified that in such cases disciplinary action is justified as the Railway servant involved is guilty of deliberate prevarication with the object of misleading the Enquiry Committee. This position holds good in cases where the statement made by the Railway servant before a Departmental Enquiry Committee is at variance with earlier statement made during a preliminary Department Enquiry or on oath before a Magistrate.
In this connection, attention is also invited to item 2 of the record of discussion of the Senior Deputy General Managers’ Conference with the Board held on 12th and 13th May, 1959, forwarded under Board’s letter No.E58 vc1-104, dated 13.08.1959.
