Sub:     Alteration of recorded date of birth.

Reference your Additional Chief Personnel Officer’s D.O. Nos.P(B)212/PGT/RNV, dated 20/26.02.1985 and No.P(B)212/P/Vol.III, dated 20.02.1985 on the above subject, Ministry of Railways have carefully considered the matter and in modifications of their earlier orders No.E(NG)II-78/BR/2, dated 04.03.1978 decided that where the date of birth in the matriculation certificate has been corrected by the State Education Authority at the instance of or on direction from a Court of Law, the request of the employee for alteration in the recorded date of birth may be considered provided that where the court was moved by the employee before 31.07.1973 he had also made a representation to the Railway Administration before 31.07.1973. This power can be exercised by the General Manager personally, and should not be re-delegated. It is however clarified that though the request of the employee could be entertained it need not necessarily be accepted. Relevant consideration like why the employee could not move a court of competent jurisdiction before 31.07.1973 and whether the employee had derived any advantage by declaring the original date of birth which he would not have got as per the revised certificate as also whether the date recorded was as per matric certificate or on some other basis will be taken into account by the General Manager before deciding the case and the reasons for accepting or rejecting the representation will be placed on record.

Representations have been received requesting for alteration of the recorded date of birth on the basis of the subsequent revision of date of birth in their Secondary School Leaving Certificates (Matriculation Certificates) by the State Educational Authorities on the direction of Court orders obtained by the employees.

The last letter received by this Railway on the subject from Board is one cited above (copy enclosed for ready reference) by which the Chief Personnel Officer may agree to change in the recorded date of birth provided the change in date of birth is based on the Matriculation Certificate and a reasonable explanation is forthcoming about the delay in asking for a change.

I shall be glad if you could please clarify the position whether the CPO may act on the direction given in the above cited Board’s letter or if any other revised orders are in vogue. If it is the latter case, a copy of the order may please be sent early. This has reference to my telephonic conversation with you on 06.02.1985.
