D&A Rules – Employee under suspension – Defence Helper

No.E54 RG6-10, dated 28.06.1954

Sub: Rules regulating Discipline and Appeals of non gazetted Railway staff.

A question has been raised whether a railway servant who has been suspended from duty could assist another accused Railway servant at a departmental enquiry. The Board have carefully considered this matter and have decided that a railway servant under suspension should not be permitted to act as Counsel or Accompany the accused Railway servant irrespective of the fact whether he is an office bearer of a Union or not. The same restrictions apply in the case of personal hearing given in terms of Rule 1721(A) R-I.
(This disposes of letter No.E.308/14/7, dated 20th April, 1954)
