D&A Rules – Defence Helper/ ARE – Restrictions

Sub: RS(D&A) Rules, 1968.
With reference to Note 2 below sub rule (9) of the Railway Servants (Discipline and Appeal) Rules, 1968, it has been decided that the restriction that at the time of nomination, the assisting person (Defence Helper/ ARE) should not have more than two pending disciplinary cases in which he has to assist, will not apply if the nominated person is a Railway Trade Union Official who is a full-time Union Worker, provided that not more than one adjournment of the enquiry will be granted on the ground of his inability to attend the enquiry. The restriction, however, will continue to apply where the nominated person is not a Railway Trade Union Official.
This has the sanction of the President of India.
Necessary amendment to the RS(D&A) Rules, 1968 is being made and will be notified shortly.

Whether a charged official can engage two defense counsels in a major penalty case? If so, kindly quote authority there to. If not, kindly mention authority.
