Casual Labour: RBE No.39/1987 – Terms of employment

Sub:   Project Casual Labour – Terms of employment regarding.

1. Attention is invited to Para 5.2.3 of this Ministry’s letter of even number dated 11.09.1986 (RBE No.167/1986) on the above subject in which it was stated that seniority list of project casual labour engaged by project organisation will be recast by the Zonal/ Construction Railway Administrations to cover all project casual labour who have been in employment at any time from 01.01.1981 onwards.

2.     Pursuant to directions given by the Hon’ble Supreme Court in their order dated 23rd February, 1987, in W.P. No.332 of 1986, the Ministry desire that the cases of project casual labour who had worked as such before 01.01.1981 and who were discharged due to completion of work or for want of further work, may also be considered for the purpose of implementation of the scheme contained in the Ministry’s letters of even number dated 01.06.1984 and 25.06.1984 as modified in the letter dated 11.09.1986 (RBE No.167/1986).

3.     It is made clear hereby that the cases of only such persons who bad worked as project casual labour before 01.01.1981 and who were discharged for want of further work or due to completion of work and who submit written representations with adequate documentary proof in this regard so as to reach the concerned Railway Divisional Office on or before 31.03.1987, will be considered for this purpose. The representation should contain particulars like name, father’s name, date of birth, permanent address, present address, educational qualifications, personal marks of identification, the Office, Department and place (mentioning the concerned Railway Division) in which initially engaged, the office from which last discharged, date and reasons for such discharge and where and how employed since last discharge as project casual labour on Railways. A true attested copy of the casual labour card and any other proof of having worked as project casual labour on Railways as also an attested copy of photograph, and attested LTI (Left Hand Thumb impression) should accompany the representation.

4.     This representation should be sent by Registered post to the Divisional Railway Manager of the Division in the territorial jurisdiction of which the person was initially engaged as project casual labourer. A copy thereof should also be sent to Project Office and also to the Divisional Railway. Manager of the Division (if that happens to be different) in the territorial jurisdiction of whose Division the Office from which the person was last discharged, falls. Project Offices receiving representations in terms of these instructions should ensure that they forward them to and get them received by their Division latest by 1st April 1987. Verification of the genuineness of the claim and thereafter processing of the application will be done by the Division in the jurisdiction of which the applicant was initially engaged as project casual labour.

5.     Representations alongwith documentary proof reaching the Offices mentioned above after 31.03.1987 or those which are incomplete and also those not made with reference to these instructions, will not be considered.

6.     Railway Administrations may take immediate action to give publicity to these instructions through circulars to be displayed in all Divisional Offices, important Railway Stations and in such other manner as may be considered necessary.
