Vakalatnamas: RBE No.162/1986 – Authority Competent to Sign

Sub: Appointment of officers who can sign and verify plaints and written statements and act for or on behalf of Central Government in respect of any judicial proceedings relating to the Railway Administrations.

Attention is invited to this Department’s notifications No.E(G)82 LL2/2, dated 21.02.1983 appointing officers by  whom plaints and written statements in suits in any Court of Civil Jurisdiction by or against the Central  Government shall be signed and authorising officers to act for or on behalf of Central Government in respect of judicial proceedings relating to the Railway Administrations. It has been brought to the notice of the Department of Railways that the instructions contained in the above referred notifications are not being followed by the Railways and the plaints, written statements, Vakalatnamas etc., are being signed even by Class II officers who are not competent to do so.

The Department of Railways desire that the instructions contained in the above referred notifications should be strictly adhered to and it may be ensured that the plaints, written statements etc. are signed and verified by the officers who are authorised to do so and to act on behalf of Government in the above referred notifications to avoid any legal complications.
