RBE No. 05/2021: Law Assistant – Recruitment

Sub: Eligibility criteria for selection to the post of Chief Law Assistant in Level-7.
1. Attention is invited to Para 131 of IREM Volume-I, elaborating the procedure of filling up the post of Law Assistant (LA). It inter-alia provides that 60% of the posts should be filled up by promotion on the basis of selection of serving employees in grades lower than the grade of Rs.6500-10500, having 5 years regular service in Group ‘C’ and possessing a Degree in Law, irrespective of the department in which the employee may be working.
2. It has come to the notice of the Board that there is no uniformity in the procedure being followed by the Railways with the regard to eligibility criteria for filling up the post of Chief Law Assistant in Grade Pay Rs.4600 (Level-7).
3. The matter has been considered carefully by the Board and it has been decided that the 60% promotion quota should be filled on the basis of selection of serving employees in Level 2 to Level-6, irrespective of the Departments in which they may be working, having 5 years regular service and possessing a Degree in Law.
4. Para 131(2)(iii) of the Indian Railway Establishment Manual, Volume-I, stands amended accordingly as per ACS No.273 enclosed herewith.

Chapter-I, Section-B, Sub Section-III (Recruitment and Training) – Rules governing the filling up posts in the category of Law Assistant.
1. Amend the sub-para 2(iii) of Para No.131:
“The remaining 60% posts should be filled by promotion, on the basis of selection, from among serving employees in Level-2 to Level-6, having 5 years regular service and possessing a Degree in Law, irrespective of the Departments in which they may be working. The shortfall against promotion quota, if any, will be filled by Direct Recruitment.”
