RBE No. 136/2008: Ex-Gratia Payment to Families of Railway employees

Sub: Payment of Ex-Gratia lump sum compensation to the families of Railway employees who die in harness in performance of bonafide official duties.
Ref: Board’s letter No.E(W)99/CP-1/1, dated 05.11.1999 (RBE No. 285/1999).
1. In partial modification of OM No.45/55/97-P&PW(C), dated 11th Sept., 1998 circulated under Board’s letter dated 05.11.1999 (RBE No. 285/1999) under reference on the above mentioned subject, sub-paras (a) to (c) under para-5 of the DOP&PW’s OM dated 11.09.1998 since amended vide their OM No.38/37/2008-P&PW(A), dated 02.09.2008 may be substituted and read as under:-

Death occurring due to accidents in the course of performance of duties |

(b) |
Death occurring in the course of performance of duties attributable to acts of violence by terrorists, anti-social elements. Etc. |

(c) |
Death occurring during (a) enemy action in international war or border skirmishes and (b) action against militants, terrorists, extremists etc. |
Rs.15.00 lakh |
|
(d) |
Death occurring while on duty in the specified high altitude, inaccessible border posts, etc. on account of natural disasters, extreme weather conditions. |
Rs.15.00 lakh |
2. These orders are applicable in the case of Railway servants who die in harness on or after 01.01.2006.
3. This has the sanction of the President and issues with the concurrence of Finance Directorate of the Ministry of Railways.
