RBE No.69/1992: Promotion – Within Group ‘C’

Sub: Promotion to higher grades in Group ‘C’.

1. As the Railway Administrations are aware, in terms of provisions contained in para 189(a) Section B, Sub-section IV, Chapter-I of IREM (Revised Edition 1989) 33-1/3% of vacancies in certain Group ‘C’ categories are filled by promotion of group ‘D’ staff for whom no regular avenue of promotion exists. The quota for promotion of group ‘D’ staff in the Accounts Department is 25%. However, in accordance with Board’s letter No.E58 CFP/8, dated 30.06.1959, staff in Class III grade Rs.60-75 along with Group ‘D’ staff in Rs.55-85 were entitled for promotion to lowest Class III posts in specified categories. Thus, in these specified categories, along with Group ‘D’ staff, Group ‘C’ staff in scale Rs.825-1200 are also eligible to be considered for promotion for Group ‘C’.

It has come to the notice of the Board that in some of the Railways Group ‘D’ staff who were earlier eligible for being considered for promotion to Group ‘C’ posts against the quota earmarked for promotion of Group ‘D’ staff were deprived of this avenue on the ground that they have since been placed in Group ‘C’ scale (Rs.825-1200 and Rs.950-1400/950-1500) as a result of restructuring of the cadres.
3. The matter has been reviewed by the Board inter alia in the light of Supreme Court’s decision in CA No.3961 of 1987 Nirmal Chand Bhattacharjee & Ors. v. Union of India and it has been held that the up-gradation of certain Group ‘D’ posts of Group ‘C’ should not result in such staff being placed in a disadvantages position vis-à-vis their counterparts who continue to be in Group ‘D’. It has accordingly been decided that the employees who were otherwise eligible (but for cadre restructuring) for concentration for promotion to Group ‘C’ against the quota prescribed for Group ‘D’ employees would continue to be eligible for such consideration irrespective of the fact that they have since been placed in Group ‘C’ scale of Rs.825-1200/ Rs.950-1500 as a result of restructuring of cadres.
4. Necessary corrections to IREM is being issued separately.
