RBE No. 16/1985: Immediate Relief – Recovery from SRPF – Railway Servants Who Die While in Service

Sub: Scheme for providing immediate relief to the families of Railway servants who die while in service.
Ref: This office letter No.E(W)72 WE6-15, dated 21.04.1973.

1. In para (v), it was provided that the advance will be adjustable against the arrears of pay and allowances, including leave salary, special contribution to SRPF, Death-Cum-Retirement Gratuity, balance in the SRPF, Contributory/ non-contributory or any other payment due in respect of the deceased Railway servant and becoming payable to the family.
2. In terms of the PF Act, 1925, adjustment of employee’s own subscription in his SRPF amount for recovery of Government dues is ‘ultra-vires’ to the provisions contained in the Act. Accordingly, the question of recovery of advance granted for providing immediate relief to the families of Railway servants who die while in service, from the SRPF has been under consideration in consultation with the Ministry of Finance. It has been decided that since recovery of Government dues is not permissible from the employee’s own subscription towards Provident Fund, no such recovery should be made as the same would be illegal. The recovery of the amount of immediate relief should accordingly be regulated and affected only from the permissible dues.
3. Necessary instructions in this regard may please be issued to all concerned immediately to ensure compliance.
4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
