RBE No. 197/2018: Fixation of Pay – RS(RP)Rules – Revision of Option

Sub: Railway Services (Revised Pay) Rules, 2016 – Opportunity of revision of option to come over to revised pay structure.
1. Please refer to Rule 5 & 6 of RS(RP)Rules, 2016 (RBE No. 90/2016) regarding exercise of option to come over to revised pay structure effective from 01.01.2016 as modified by the RS(RP)Rules, 2016. The said option was to be exercised within 3 months of the date of notification i.e. 28.07.2016 (RBE No. 90/2016) of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final.
2. In this context, it is stated that Ministry of Finance, Department of Expenditure vide their OM No.4-13/17-IC/E-IIIA, dated 12.12.2018 permitted opportunity to Government Servants to revise their initial option in terms of Rule 5 & 6 of CCS(RP) Rules, 2016. These orders issued by the Ministry of Finance, Department of Expenditure shall be applicable mutatis-mutandis in Railways in respect to RS(RP)Rules, 2016.
3. The ‘three months’ period mentioned in para 3 of aforesaid OM of Ministry of Finance, Department of Expenditure dated 12.12.2018 shall be three months from the date of issue of these instructions.
4. The matter has also been raised by both recognized Staff Federations AIRF and NFIR.

Sub: Central Civil Services (Revised Pay) Rules, 2016 – Opportunity for revision of option to come over to revised pay structure.
1. The undersigned is directed to invite attention to Rules 5 & 6 of the CCS(RP) Rules, 2016 regarding exercise of option to come over to the revised pay structure effective from 01.01.2016 as notified by the CCS(RP) Rules, 2016 and to say that said option was to be exercised within 3 months from the date of notification i.e. 25.07.2016, of the said Rules. The Rule 6(4) thereof provides that the option once exercised shall be final.
2. The staff side of the National Council (JCM) has requested that employees may be given another opportunity to re-exercise their option in view of certain hardships caused to certain employees. A large number of references have also been received in this Ministry, proposing that the affected employees may be given an opportunity to re-exercise their option.
3. The matter has been considered and the President is pleased to decide that in relaxation of the stipulation contained in Rule 6(4) of CCS(RP) Rules, 2016, the Central Government Employees, who have already exercised their option to come over to the revised pay structure as notified by the CCS(RP) Rules, 2016, shall be permitted another opportunity to revise their initial option in terms of Rules 5 & 6 thereof. The revised option shall be exercised within a period of 3 months from the date of issue of these orders. The option once exercised in terms of these orders shall be final and shall not be liable to any further change under any circumstances. All other terms and conditions as laid down in the said Rule 5 & 6 shall continue to be applicable.
4. It is obvious that in respect of all those employees who have already exercised option to come over to the revised pay structure from 01.01.2016 itself or in whose case the revised pay structure took effect form 01.01.2016 and who re-exercise their option under these orders to come over to the revised pay structure from a date subsequent to 01.01.2016 as per Rule 5 of CCS(RP) Rules, 2016, the arrears on account of revised pay already drawn by them from 01.01.2016 up to the date from which they now opt to come over to the revised pay structure shall be recovered.
5. In their application to the employees serving in IA & AD, these orders were issued after consultation with the Comptroller and Auditor General of India.

Pease issue a clarification on,” A staff getting promotion in between 01.01.2016 in VI cpc opted for fixation on 01.07.2016(i.e next date of increment ) in VI cpc ,can opt for fixation of Pay in VII cpc from 01.07.2016 based on pay of the staff thus fixed in VI CPC on promotion.”
Date of increment to be changed January instead of july
Initially my date of increment is January. After that it is fixed July from 2009. Am I get revision as per RBE no 197/18
Seeking deep clarification of RBE no. 197/2018. Can I switch over 7th CPC up to date of my financial Upgradation 07/8/2016. ( Gp 4200 to 4600)
Clarification of RBE No. 197/2018. I have been promoted on 19.11.2015 from GP-4200 to GP-4600, whether option to switch over to 7th CPC pay structure can I have benefit. If I draw my pay in GP-4200 till 31.12.2015 and considering my date of promotion W.E.F 01.01.2016 in GP-4600.
Clarification of RBE No 197/2018, I have been Promoted on 10.3.2016 from GP 4800 to 5400, I opted to switch over to 7th CPC pay structure from the date of next date of increasement. I donot get 7th CPC benefit till 30.6.2016.Now administration says you have to get fixation from the date of promotion. Can I have not switch over from the date of next increasement.
