Teachers: RBE No.147/1985 – Entitlement of Earned Leave

Sub: Entitlement of 10 days, earned leave on full pay during a year in lieu of 20 days’ half pay leave for the teachers working in Railway Schools – Clarification.
1. Reference this Ministry’s letter of even number dated 11.12.1981 on the above subject. Some doubts have been raised about the implementation of the same. The matter has been considered in consultation with the Ministry of Home Affairs, Deptt. of Personnel and the same are clarified as under:-

2 | Whether the half pay leave at the credit of teachers as on 11.12.1981 is to be accounted for separately in the leave account and teachers can be allowed to avail this leave on medical grounds. | Half pay leave at the credit of teachers as on 11.12.1981 is to be shown separately in the leave account and may be granted as half pay leave/ commuted leave on the same terms and conditions as were applicable to them prior to issue of letter dt. 11.12.1981. |
3 | Since no half pay leave will be admissible to the teachers who have been appointed after 11.12.1981 it is presumed that they will not be entitled to commuted leave on medical grounds. | Teachers appointed after 11.12.1981 will not be entitled to any half pay leave and there is therefore no question of granting commuted leave on medical grounds. |
4 | In the case of employees other than teachers, 15 days’ earned leave is at present credited in their leave account on 6 monthly basis i.e. on first of Jan. and July each year in advance. Will the teachers also be eligible for the grant of 5 days’ earned leave after completion of six months period. | For the period from 01.01.1982 onwards 5 day’s earned leave will be credited in advance on the 1st of Jan. and July each year, as in the case of other categories of Govt. servants. |
5 | Some teachers have availed of ‘leave not due’ to be adjusted against the half pay leave to be earned in future. Since the teachers are not eligible now for half pay leave how is the ‘leave not due’ to be adjusted in such cases. | Unadjusted portion of ‘leave not due’ granted to teachers may be adjusted against the future earning of earned leave by them. For this purpose 2 days of ‘leave not due’ may be adjusted against one day of earned leave. |
6 | Whether accumulated half pay leave to the credit of teachers working under the Central Govt. can be converted into earned leave for the purpose of encashment on their retirement on superannuation. | No such conversion is permissible. |
7 | Whether encashment of leave is admissible to all the teachers who retired/ would be retired after 31.12.1981. | Encashment of leave would be admissible to teachers subject to the conditions laid down in Board’s letter No.F(E)III-77 LE-1/4, dt. 15.11.1977. |
8 | What proportion of 10 days’ earned leave per year admissible can be granted in cases where the teacher concerned retires or quits service without completing a year. | Proportionate earned leave at the rate of 5/6 days for each completed month of service is to be allowed in such cases. |
9 | Whether the teachers/ Heads of schools have any option either to avail of 20 days’ half pay leave or 10 days’ earned leave on full pay. | There is no provision for option w.e.f. 11.12.1981. Teachers including Principals and Heads of school are entitled to only 10 days earned leave during a year. |
2. This has the approval of the President and issues with the concurrence of the Finance Directorate of the Ministry of Railways.
