RBE No. 220/1988: Fixation of Pay – On Leave on 01.01.1986

Sub: Option for revised scales of pay under RS (RP) Rules, 1986 while on various kinds of leave including study leave.

1.     In the context of extent instructions that leave salary shall be the last pay drawn, doubts have been raised in regard to the manner of fixation of pay in the revised (4th Pay Commission) scales of pay in respect of railway staff who had remained on leave on 01.01.1986, or from the date of next increment from which they may have elected the revised scale. 

2.     The matter has been examined in consultation with the Department of Personnel and it is clarified that in such cases of railway servants remaining on various kinds of leave on the crucial date, except extraordinary leave/ leave without pay, the pay in the revised pay scale should be fixed notionally with effect from 01.01.1986 or from the date of next or subsequent increment, as the case may be, according to the election for the revised scale, but the actual benefit of such revised pay will accrue only with effect from the date of joining duty after expiry of leave.
