Sub: Minimum pension and minimum.

1. A copy of O.M. No.2/14/87-PIC, dated 05.03.1987 of Ministry of Personnel, Public Grievances and Pensions (Department of Pension & Pensioners’ Welfare) on the above subject (with spare copies) is sent herewith for your information and necessary action. As stated in para 5 thereof, these orders will apply to Railway pensioners also.

2. The orders corresponding to Ministry of Finance O.M.No.F.1(4)E.V.83, dated 11.04.1983 and the Department of Pension and PW’s O.M. No.42(4)-P and PW/86, dated 3rd March, 1986 referred in the above O.M. dated 05.02.1987 were issued under this Ministry’s letter No.F(E)III/82/PN/4, dated 03.06.1983, and No.PCIII/82/PN/1, dated 19.03.1986 (RBE No.60/1986).

3. The expenditure is chargeable to Demand No.13 Provident Fund, Pension and other retirement benefits. The funds may be found by re-appropriation within the existing allotment.

OFFICE MEMORANDUM

Sub: Minimum pension and Minimum family pension.

1. The undersigned is directed to refer to the Ministry of Finance, Department of Expenditure 0.M No.F.1(4)E.V/83 dated 11.04.1983 in accordance with which minimum amount of pension/ family pension (including relief) payable to Central Government pensioners was stepped up to Rs.160 and Rs.150 per month respectively. The question regarding providing further relief to low paid pensioners and family pensioners has been under consideration of the Government. The President is pleased to decide that where the total amount of pension (superannuation/ retiring/ invalid/ compensation) of family pension under the CCS (Pension) Rules, 1972/ Family pension under Central Civil Service (Extraordinary Pension) Rules, plus the relief thereon upto average Consumer Price Index 608 as indicated in this Department’s O.M.No.42(4)-P&PW/86, dated 3rd March, 1986, falls short of Rs.375 per month, the same shall be stepped upto Rs.375. As and when, any increase in pension/ family pension is sanctioned by Government in pursuance of recommendations of the Fourth Central Pay Commission, the increased pension so admissible will be taken into account for giving the benefit of the minimum pension of Rs.375 per month.

2.     The above mentioned minimum of Rs.375 per month will apply after taking into account all elements like service pension, disability pension, ad-hoc reliefs sanctioned from time to time, personal pension etc.

3.     It is hereby clarified that the minimum pension of Rs.375 per month will apply in all cases including employed/ re-employed pensioners. It is also clarified that for purposes of stepping up to Rs.375, pension will be inclusive of commuted portion if any. As such, commuted portion will be deducted from the said amount of Rs.375 while making monthly disbursements.

4.     These orders take effect from January 01, 1986 and will extend to all pensioners/ family pensioners irrespective of the date of retirement of the Government servant or sanction of family pension.

5.     These orders shall also apply to Armed Forces pensioners, civilian pensioners paid out of Defence Services Estimates, Railway Pensioners and pensioners of All India Services.

6.     All pension disbursing authorities including Public Sector Banks handling disbursement of pension on behalf of the Central Government are hereby authorised to pay pension/ family pension at the revised rates without any further authorisation from the authorities which had sanctioned pension/ family pension originally. A suitable entry regarding stepping up of pension/ family pension shall be recorded by the pension disbursing authorities in the Pension Payment Order. All pension Disbursing Authorities are requested to ensure that the arrears accruing as a result of these orders for the period from 01.01.1986 to 28.02.1987 are disbursed to the respective pensioners at the earliest, preferably by 31st March, 1987.

7.     In their application to the persons belonging to the Indian Audit and Accounts Departments these orders issue in consultation with the Comptroller and Auditor General of India.
